This document sets the terms governing the use of the website and the purchase of items on it.

The information or personal data you provide will be processed in accordance with our Privacy and Cookie Policy. By using the website, you consent to the processing of this information.

By using the website and placing orders through it, you commit to:

  • Not placing fraudulent orders. If Vivaldo Europe S.L. considers an order to be fraudulent, it is authorized to cancel it and, if necessary, report it to the relevant authorities.
  • Providing accurate contact details (email, phone, and postal address). You also consent to us using this information to contact you.
  • Declaring that you are over 18 years old and have the legal capacity to enter into contracts according to Spanish regulations.

HOW TO PLACE AN ORDER

To place an order, you must follow the online purchase procedure and the instructions provided during the order processing, as well as validate the necessary authorizations or permissions that the website may require for processing.

PRODUCT AVAILABILITY

Orders are subject to product availability. If there are difficulties in supplying products or if items are out of stock, Vivaldo Europe S.L. will refund any amounts paid by you.

PRODUCT DELIVERY

The product will be shipped on the same business day the order is placed and will be delivered within 2 business days.

Orders must be placed before 14:00 from Monday to Thursday and before 13:00 on Fridays. Orders placed outside of these times will be considered as placed on the following business day.

Delivery Times by Destination

  • Mainland Spain and Portugal: Shipment is via courier, with a delivery time of 2 to 3 business days.
  • Balearic Islands: Shipment is via courier, with a delivery time of up to 2-3 business days.
  • Canary Islands: Shipment is via Correos Paq Estándar, with an estimated delivery of 7 to 9 business days.
  • Ceuta and Melilla: Shipment is via Correos, with a delivery time of 7 to 9 business days.
  • International Shipments: For products ordered with delivery abroad, the product will be delivered within the time communicated by email, which will not exceed 22 days.

Please note that delivery times may experience delays during peak ordering periods, such as the Christmas season, due to transportation service providers being overloaded. Delivery days are from Monday to Friday, excluding Saturdays, Sundays, and holidays.

If for any reason we are unable to meet the delivery times or date, Vivaldo Europe S.L. will inform you of this and give you the option to either continue with the purchase by setting a new delivery date or cancel the order with a full refund of the amount paid.

For the purposes of these terms, delivery is considered to have occurred when you, or a third party authorized by you, take possession of the products in the order. This will be confirmed by the signing of the order receipt at the delivery address provided.

If you are not going to be at the delivery address or no authorized person will be available at that location, the package will be delivered to the nearest pickup point (GLS Parcel Shop or Post Office).

What will shipping cost me?

Shipping rates from our facilities vary based on the delivery location and the total order amount. Below are the costs and conditions:

Spain

  • Mainland: €3.95 (free shipping for orders over €50).
  • Canary Islands, Ceuta, and Melilla: €6.95 (free shipping for orders over €50).

Portugal

  • Mainland Portugal: €6.50 (free shipping for orders over €50).
  • Overseas Portugal: €14.50 (free shipping for orders over €70).

Andorra

  • International Standard: €5.50 (free shipping for orders over €50).

Europe (EU)

  • International Standard: €10.25 (free shipping for orders over €70).
  • International Express: €12.50 (no free shipping option).

Europe (Non-EU)

  • International Standard: €14.50 (free shipping for orders over €80).

United Kingdom

  • International Standard: €7.50 (free shipping for orders over 50 GBP).

Switzerland

  • International Standard: €10.50 (free shipping for orders over 70 CHF).

International (Australia, Canada, New Zealand, USA)

  • International Standard: €17.50 (free shipping for orders over €80).

Note: Delivery times vary by region, and estimated delivery times are detailed during the purchase process.

Item prices listed on the website include the applicable Value Added Tax (VAT) and are shown in Euros by default. However, on our website, the customer can choose and view prices in different currencies according to their preference.

INABILITY TO DELIVER THE ORDER

If it is impossible to deliver your order to the specified address, we are authorized to seek a safe destination to leave it (e.g., a building concierge or a neighbor), and you will be informed of this circumstance. If delivery is not possible, the order will be returned to our warehouse in Madrid.

If 15 days pass since your order was made available for delivery and it has not been delivered due to reasons not attributable to Vivaldo Europe S.L., we will assume that you wish to cancel the order and will proceed with the cancellation.

In case of cancellation, we will refund the price of the items (excluding delivery costs paid by the customer).

If you did not pay for shipping due to a promotion or because your order exceeded a minimum amount of €50, we will refund the full amount, including return shipping costs. The refund will be processed within 14 days of the cancellation date.

PRICE AND PAYMENT

Website prices, as previously stated, include VAT but do not include shipping costs, which will be added to the total amount due according to the shipping conditions specified earlier.

Furthermore, prices may vary at any time. However, any changes will not affect orders that have been confirmed prior to the price change and for which an order confirmation has been sent.

Payment Methods Available at Vivaldo Europe S.L.

Vivaldo Europe S.L. offers several payment options for your convenience:

  • Credit Card Payment: We accept payments with Visa and MasterCard cards. The payment process is conducted in a secure environment managed by Redsys. Credit card details are encrypted using SSL security protocol and transmitted directly to the corresponding financial institution, which processes the payment and either accepts or rejects it. Therefore, the only entities that know the card details are the customer, Redsys, and the issuing bank. Vivaldo Europe S.L. does not have access to this data and only receives payment confirmation from the bank. If your bank does not authorize the payment, Vivaldo Europe S.L. is not responsible for any delays or failure to deliver, nor will it be able to formalize the contract with you.

  • PayPal: A secure payment method that allows the customer to make the transaction without sharing payment details with Vivaldo Europe S.L., as only the purchase confirmation from PayPal is received to proceed with the order shipment.

  • Apple Pay / Samsung Pay / Google Pay: We have payment gateways available for customers to complete purchases via these payment methods, providing an additional option for convenience and security.

VAT AND INVOICING

Under Article 68 of Law 37/1992 of December 28, of VAT, the delivery of products is deemed to have occurred in the territory where Spanish VAT applies if the delivery address is within Spanish territory, except for the Canary Islands, Ceuta, and Melilla, which are exempt from VAT as stated in Article 21 of the aforementioned law.

The VAT rate applied will be the one in force at the time of purchase.

The customer authorizes us to issue the invoice in electronic format. However, if a paper invoice is preferred, it can be requested by contacting our customer service through any of the available contact methods.

RETURN POLICY

What is the return period?

The customer has a period of 14 calendar days from the date of receipt of the product to return it without the need to justify the reason.

Conditions for Acceptance of Return

For the return to be accepted, the product must meet the following conditions:

  • Be in perfect condition, with no signs of use.
  • Have the original packaging intact and without visible damage.

If the product shows any damage, signs of use, or lacks the original packaging, Vivaldo Europe S.L. reserves the right to reject the return.

Return Shipping Costs

  • If the customer decides to return the product for personal reasons (withdrawal), the shipping and return costs will be borne by the customer, even if the initial order had free shipping.
  • If the return is due to a shipping error or a product defect, Vivaldo Europe S.L. will cover the return shipping and delivery costs.

Return Procedure

To exercise the right of withdrawal, the customer must:

  1. Complete the withdrawal form in the “My account” section or send a clear declaration stating the intention to withdraw from the contract, including:

    • Full name and address of the customer.
    • Order number and product name.
    • Statement of withdrawal from the sales contract.
    • Date of communication.

  2. Send the product within 14 days from the withdrawal notification to the following address:

Vivaldo Europe S.L. will issue the refund using the same payment method within a maximum of 14 days after receiving and inspecting the returned product.

WARRANTIES

If the customer purchases as a consumer, products sold by Vivaldo Europe S.L. come with the warranty set by current European Union legislation, with a 2-year coverage from the delivery date.

Warranty Coverage

The 2-year period applies to all consumer goods, including durable goods and items without electronic components, such as plastic cases. The warranty covers any manufacturing defect or hidden defect that appears within this period.

Warranty Limitations

The following are excluded from the warranty:

  • Normal wear and tear of the product due to use.
  • Damage caused by misuse or improper handling.
  • Defects attributable to improper use of the product.

If any product does not conform to the contract due to a manufacturing defect, the customer must notify Vivaldo Europe S.L. through the contact channels provided in this document as soon as possible to process the warranty.

UNFORSEEABLE EVENTS

Vivaldo Europe S.L. is not responsible for any failure or delay in fulfilling its obligations if caused by circumstances beyond our control, such as:

  • Strikes, lockouts, or protests.
  • Civil unrest, terrorism, or war conflicts.
  • Natural disasters or damage to our facilities.
  • Inability to use transport methods (road, train, plane, or boat).
  • Pandemics.
  • Government-imposed restrictions affecting businesses and public mobility.

PARTIAL NULLITY

If any of the conditions in this document are declared void or invalid by a judicial decision, the other conditions will remain applicable and in force.

MODIFICATIONS OF TERMS AND CONDITIONS

Vivaldo Europe S.L. reserves the right to modify the terms and conditions of this document when necessary. In case of modifications, these will be published on our website.

APPLICABLE LAW AND JURISDICTION

The use of this website and purchases made through it are governed by Spanish law.

Any dispute arising in connection with the use of the website or purchases made will be submitted to the jurisdiction of the Spanish courts. However, as a customer, this agreement will not affect the rights you have under the applicable law in your country of residence if you are a consumer.
